The President authorizes the appointment of an auditor to conduct an audit of the income and expenditure of the state, government and statutory organizations and the duties of administrative agencies and officials. Land and resources are protected by the state, and the state formulates balanced development and utilization plans. The state strives to realize the principle of economic freedom of cultivated land and prohibits the system of leasing cultivated land. The Supreme Court has one Supreme Court Justice. However, according to the provisions of the law, judges who are not judges of the Supreme Court can be appointed. The President may declare martial law when necessary and under the authority of law to respond to military necessity or to maintain the common interest as a fighting force in times of war, incident, or equivalent national emergency.
The president may not concurrently serve as prime minister, member of the State Council, minister of administration, or other public office prescribed by law. Military courts may set up courts specifically to try military cases. Workers have the right to independent solidarity, collective bargaining and collective action to improve working conditions. The President bears great responsibility for ensuring the peaceful reunification of the country. All citizens are required by law to pay taxes. The organization, powers and other necessary matters of election committees at all levels shall be prescribed by law. The President may issue a presidential decree on authorized matters, clarifying the scope of the law and matters necessary to implement the law. Everyone has the right to immediate counsel when arrested or detained. However, if the defendant is unable to hire an attorney on his or her own, the law requires the state to hire an attorney.
The Director is appointed by the President and approved by Congress. The term is four years and can only be re-elected for the first time. No one may be arrested or detained unless he or she is informed of the reasons for the arrest or detention and has the right to legal advice. The reason, date and place of the arrest must be notified immediately to persons with legal obligations, such as family members of the person arrested or detained. When the President is absent or unable to perform his duties due to an accident, he exercises power on behalf of the Prime Minister and statutory members of the Council of State. All citizens enjoy personal freedom. No person may be arrested, detained, seized, searched, or interrogated except in accordance with the law, and no penalty, mandatory security measures, or forced labor may be imposed on any person except in accordance with the law and due process.
